Membership terms & conditions:
The Membership Agreement ("Agreement") for the type of membership indicated below, is between the Training Edge Heath Club ("The Club") and the signed applicant ("Applicant"). The applicant further agree and understand that:

Initiation Fee and Membership Dues: In consideration of the membership, The applicant is paying a non-refundable, non-transferable, once off initiation fee. Unless dues are pre-paid for a period, the monthly billing of this membership will be as follows:
This agreement will be for a minimum term of (3 / 6 / 12 / 24) months (the term) at a discounted rate, via EFT (Electronic funds transfer) based on the terms and length of the agreement from the starting date of the contract.
• Any breach of the payment obligation as required herein shall cause an administration fee to be charged, applicable at such a time.

Termination of Monthly Membership: Unless this agreement is terminated, it shall automatically be renewed on a month to month basis at the expiration of the minimum term. This agreement is subject to an annual escalation fee, subject to CPI regardless of the start date/minimum term of the agreement. The Club reserves the right to increase membership fees further in it's sole discretion, should municipal rates & taxes be increased by local authorities. A member may terminate his / her membership after the expiration of the minimum term by notifying The Club and EFT Administrators in writing 60 days in advance from payment date of debit order on contract and paying all amounts then due and owing to The Club. All cancellations granted (with valid documentation) within the minimum term of the contract will be subject to the payment of a cancellation fee within 30 days. Notice of all are to be done on official forms available at reception, or posted by registered mail to: EFT Administrators, PO Box 28965, Danhof, 9310. The client will be informed in writing whether the application was approved. The member is responsible to check that no further payments are deducted from his / her account after the approved cancellation months. No refunds will be done longer than 3 months after the approved cancellation months. The member is obliged to pay dues regardless of whether he / she uses club facilities until the end of the termination period.

Extension & Transfers: The membership may be extended (for a valid reason & proven with documentation) for a minimum of 1 (one) month and a maximum of 6 (six) months. A monthly levy will be due for approved applications. • Transfers for prepaid memberships will be approved (for a valid reason & proven with documentation) at the discretion of the club. A transfer fee payable within 30 days will be applicable for any approved transfers. No refunds will be done for any approved transfers.

The Club has the right to verify registration/employment at any stage, for the member to qualify for the reduced rate. If no verification is received the rate will be adjusted to the applicable rate at such a time regardless of the start date / minimum term of the agreement.

Maintenance Levy: In addition to your membership fees, a maintenance levy to the value of half the monthly fee of a 12 month single membership, valid at the time, will be charged every September.

Release and waiver of liability: The Applicant, and dependants understand and agree that:

use of The Club’s facilities, equipment, services, programs and premises involves an inherent risk of injury to persons and property,
-
they are medically and physically fit to use an exercise program and Club facilities. They have consulted a physician and he / she has approved their contemplated activities at The Club. They waive all claims which they might have against The Club and hereby indemnify The Club in respect of any claims that might arise as a result of my / our using the facilities and programs.

The Club is not responsible for lost or stolen articles. The applicant/s undertake to keep valuables with them or locked away at all times while using the facilities. They agree that the release and waiver of liability is valid from date that this agreement was signed.

It is acknowledged that The Club and or third parties for marketing purposes and the like may use my personal details given herein. I herewith agree to such purposes.

The applicant understand that they have absolutely no claim whatsoever against The Training Edge Health Club. Any grievances in connection with The Club should be directed to the The Training Edge Health Club and put in writing and sent by registered post to: The Manager P.O Box 8215, Whiteriver, 1240.

Rules and Regulations: The Club reserves the absolute right to change The Club's Rules and Regulations. All signs posted in The Club shall be considered part of the Rules and Regulations. Members and their guests shall be bound by the Rules and Regulations of The Club. Rules and Regulations may be revised, supplemented, or amended at the sole discretion of The Club as deemed necessary for the proper management of The Club. THESE RULES AND REGULATIONS SHALL BE CONSIDERED A PART OF THE MEMBERSHIP AGREEMENT.

Entire Agreement and Modification: This agreement will constitute the entire agreement between the applicant and The Club. The applicant acknowledge that no other agreement exists between themselves and The Club relative to the membership and that no representations other than those set forth in this agreement have been made to them to induce them to make this agreement. This agreement can only be terminated as set forth in paragraph 2.
Conditions of EFT:
EFT Administrators is authorised to draw (from any bank, building society or branch to which the account may be transferred) the installment amount as indicated on behalf of The Club. Payment shall be made on the FIRST, FIFTEENTH or TWENTY FIFTH day of each month, or the closest business day there to. The member / payer agrees to pay any bank charges relating to this debit order instruction. This authority may not be cancelled by the member unless an application for resignation has been authorised by The Club. The member / payer will not be entitled to any refund of amounts which have been withdrawn while this authorisation was in force if such amounts were legally owing to The Club. EFT Administrators reserve the right to debit member’s / payer's account for any unpaid amount, at any time of the month. The member / payer warrant that the information given by them regarding the membership / EFT is true and correct in every respect. The member / payer undertake to notify The Club in writing by registered post of any material change in my circumstances. The member / payer choose the address disclosed in the agreement as their domicilium citandi et executandi for all purposes arising out of this agreement.
The member / payer further agree:

In the event of the membership being handed over for collection, the non-discounted monthly rate prevailing at that time will be charged for the full term of the contract.

To pay the interest on the arrears, calculated at an annual rate of 21% from due date to the date upon which such arrear amount is paid in full.

To pay for the cost of all letters, telephone calls and tracing fees resulting from my being in arrears and, should the balance of the total sum be handed over for collection, to pay all legal charges as between attorney, collection agent and client together with collection commission.

Cardio Fat Burners (CF) |

These classes are designed to increase the capacity of cardiovascular and respiratory systems of the body, while achieving a total body workout. |

Fat Burners (FB) |
|
These are excellent classes for weight loss and secondary firming up. They are low impact workouts, using the larger muscle groups of the body resulting in the body working in the energy system that burns fat. (60 - 70% of your maximum heart rate) |

Toning Classes (T) |
|
These classes are aimed at toning and firming the larger muscle groups, i.e: abdominal, buns, thighs, etc. The majority of these classes are spent in a stationary position, doing controlled exercises. |
